Terms of service

1. Provider

Finmas, trgovina in storitve Nataša Fink s.p., Pod Trško goro 91A, 8000 Novo mesto, VAT ID: SI95165479. All prices include 22 % VAT.

2. Subject

Building a website or online store according to the chosen package (Landing page, Business site, Custom, Starter store, Business store, Custom store) and, optionally, site or store care (hosting, domain, updates) for a monthly fee.

3. Prices and payment

• The build is paid in two parts: 50 % on order, 50 % on approval of the preview, before launch.
• The monthly site care fee is charged from launch. If payment is over 30 days late we send a reminder; over 60 days we may take the site offline temporarily.
• Prices may change with 30 days' notice. A confirmed quote stays valid until the end of the project.

4. Timelines and materials

• The timeline starts when we receive complete materials and a confirmed quote.
• The client responds to the preview within 3 working days. After 10 days without a response, the provider may launch the current version.
• The client warrants that they hold the rights to the supplied images, copy and logo.

5. Revisions

A revision round is one set of comments in one message. The number of included rounds is stated in the price list. Extra work is charged according to the add-ons table or at 35 € per hour, after prior approval.

6. Rights

• Content (copy, images, logo) belongs to the client.
• Code built for the client is transferred to the client on payment. The provider's general components and tools remain the provider's property; the client may use them on their site without restriction.
• The domain is registered to the client; the provider is the technical contact for as long as site care lasts.
• The provider may list the site as a reference unless the client declines in writing.

7. Site and store care

• Included: hosting, .si domain, SSL, updates, backups, uptime monitoring and a quota of minutes for minor changes. Unused minutes don't carry over.
• Not included: new subpages, a new design, copywriting, advertising, email hosting.
• We fix downtime within 24 hours on working days and make minor changes within 2 working days.
• No lock-in. Cancellation in writing with one month's notice.

8. Cancellation and handover

On cancellation the client receives an export of the whole site and the domain transfer code. 30 days after the last monthly fee we take the site offline; a backup is kept for a further 90 days.

9. Limitation of liability

The provider does not guarantee search rankings or visitor numbers. Liability is limited to the amount paid in the last 12 months. The provider is not liable for outages of third parties (hosting, registrar, Google).

10. Personal data processing

For visitors' data on the client's site, the client is the controller and the provider the processor. The data processing agreement is an annex to the quote.
